PREAMBLE
Le lab de l'endo is a web platform, available at www.lelabdelendo.com (the 'website').
This Site is published by SANAFLOW, SAS with a share capital of 10,000 euros, having its registered office at 10 Rue de la Paix, Paris, France and registered with the PARIS Trade and Companies Registry under the identification number 893503516, (hereinafter "the Publisher").the Publisher') . The lab de l'endo is accessible to users (the 'Users').
Le Lab de l'Endo is hosted by Shopify, a Canadian company registered on the TSX and NYSE, whose head office is located at 151 O'Connor Street, Ottawa, ON, Canada. This host can be contacted at this email address: [email protected].
The purpose of these Terms and Conditions of Use (the 'Terms or taken as a whole, the 'Agreement) is to define the terms and conditions governing the relationship between Users and SANAFLOW. In the event of non-compliance with the terms of the present Terms, SANAFLOW reserves the right to take any measure likely to preserve its interests and in particular to ensure their enforcement.
Each time the User visits the Platform, he/she undertakes to comply with all of the present Conditions without reservation. Consequently, the User acknowledges having read the Conditions and agrees to be bound by them. If the User accesses the Platform on behalf of a company or any other legal entity, he/she is nevertheless personally bound by the present Contract.

ARTICLE 1ER PURPOSE OF THE SITE
The Site allows the User to access the following services in particular: Sale of natural, food, non-food & cosmetic products for women (the 'Service(s)') .
SANAFLOW hereby grants Users a limited, revocable, non-exclusive, non-transferable right of access to the Services on a strictly personal basis. Any use of the Platform contrary to its purpose is strictly prohibited and constitutes a breach of these Terms.
ARTICLE 2: ACCESS TO THE SITE
To be eligible for the Service, the User may be an individual or a legal entity.
SANAFLOW reserves the right to suspend or deny access to the Site to one or more Users.
ARTICLE 3: SITE MANAGEMENT
The Publisher implements the necessary technical solutions to ensure uninterrupted access to the Site for the User. However, the Publisher reserves the right to limit or suspend access to all or part of the Site at any time, without prior notice. In particular, such an interruption may be necessary to maintain the site or its content, or for any other reason deemed necessary for the proper operation of the site by the Publisher.
Use of the Platform requires a connection and an Internet browser. The Platform can be accessed at the following address: www.lelabdelendo.com. In order to guarantee proper operation of the Site, it is specified that the Site is optimized for :
- a screen resolution of 1280×768 pixels;
- the latest versions of Edge, Chrome, Firefox and Safari browsers.
All hardware and software required to access the Platform and use the Services are the sole responsibility of the User.
ARTICLE 4: REPORTING
Users may contact the Publisher to report any illicit or manifestly inappropriate behavior or content. This can be done by sending an e-mail to [email protected].
ARTICLE 5: USE OF PLATFORM SERVICES
Users agree not to:
- transmit, publish, distribute, store or destroy any material, in particular the contents of Le Lab de l'Endo, in violation of the laws or regulations in force concerning the collection, processing or transfer of personal information;
- to disseminate data, information or content of a defamatory, insulting, obscene, offensive, violent or inciting to violence nature, or of a political, racist or xenophobic nature and, in general, any content that is contrary to the laws and regulations in force or to accepted standards of behaviour;
- to reference or create links to any content or information available from the Le Lab de l'Endo sites, except with the express prior written consent of SANAFLOW ;
- to use any information, content or data contained on the Site in order to offer a service considered competitive to Le Lab de l'Endo.
- sell, exchange or monetize information, content or data present on the Platform or Services offered by the Platform, without the express written consent of SANAFLOW ;
- reverse engineer, decompile, disassemble, decrypt or otherwise attempt to obtain source code in connection with any underlying intellectual property used to provide all or part of the Services;
- to use manual or automatic software or devices, robots or other means to access, explore, extract or index any page of the Site;
- endanger or attempt to endanger the digital security of Le Lab de l'Endo. This includes attempts to monitor, scan or test the vulnerability of the system or network or to breach security or authentication measures without express prior authorization;
- infringe or use SANAFLOW's products, logos, trademarks or any other elements protected by SANAFLOW's intellectual property rights;
- simulate the appearance or operation of the Site, for example by using a mirror effect;
- disrupt or interfere, directly or indirectly, with Le Lab de l'Endo, or impose a disproportionate load on the Site's infrastructure, or attempt to transmit or activate computer viruses via or on the Site.
Violations of system or network security may lead to civil or criminal prosecution. SANAFLOW verifies the absence of such violations and may call upon the legal authorities to prosecute Users who have participated in such violations.
Users undertake to use the Site in a fair manner, in accordance with its purpose and with the legal and regulatory provisions, the present Conditions and current practices.
ARTICLE 6: INTELLECTUAL PROPERTY
All content on the Site, including but not limited to designs, text, graphics, images, video, information, logos, button icons, software, audio and other files, is the property of SANAFLOW, which is the sole owner of all related intellectual property rights.
Any representation and/or reproduction and/or partial or total exploitation of the contents and Services offered by Le Lab de l'Endo, by any process whatsoever, without the prior written authorization of SANAFLOW, is strictly forbidden and may give rise to legal proceedings.
ARTICLE 7: PERSONAL DATA
All personal data held by SANAFLOW is collected legally and fairly in accordance with the terms of the privacy policy accessible at this address: https://www.lelabdelendo.com/pages/conditions-generales-dutilisation.
These data are provided by Users who voluntarily and expressly accept the present Conditions authorizing SANAFLOW to process, disclose or transfer these data to any third party in order to (i) enable the User to take full advantage of the Services and functions offered by the Site, (ii) prevent any fraud and/or (iii) for statistical purposes.
In order to facilitate the use of the Site and to personalize the User's experience of the Site, SANAFLOW uses cookies and log files. The use of cookies can be disabled by modifying the browser settings.
Personal data is stored by SANAFLOW for processing in connection with the use of the Services. It is kept for as long as is necessary to provide the services and functions offered by the Site.
The User remains at all times the owner of the information concerning him/her that he/she transmits to SANAFLOW. In accordance with the French Data Protection Act no. 78-17 of January 6, 1978, as consolidated on March 24, 2020, the User has the right to access, rectify and delete personal data concerning him/her, as well as the right to object to the communication of such data to third parties for valid reasons.

A reply to the User's request will be sent within 30 days.
ARTICLE 8: LIABILITY
Users are reminded that data published by them and information shared by them may be collected and used by other Users or third parties. In this respect, SANAFLOW does not guarantee that the ownership of such data will be respected, and it is the User's responsibility to take all necessary steps to ensure that the ownership of such data is preserved.
SANAFLOW does not guarantee uninterrupted or error-free operation of the Services. In particular, SANAFLOW shall not be liable for any interruption of access to the Platform due to maintenance, updates or technical improvements.
In no event shall SANAFLOW be liable for any indirect or consequential loss or damage to the User or any third party, including, without limitation, any lost profits, investment losses, inaccuracy or corruption of files or data, loss of image or business, loss of sales or profits, loss of goodwill or loss of opportunity, whether in contract, tort, strict liability or otherwise.
In addition, SANAFLOW shall not be liable for any delay or non-performance of this Agreement caused by force majeure, as defined by the jurisprudence of the French courts.
ARTICLE 9: PROOF AGREEMENT
Computer systems and files are authoritative in relations between SANAFLOW and the User.
Thus, SANAFLOW may validly produce in any proceedings, for purposes of proof, the data, files, programs, recordings or other elements, received, issued or stored by means of the computer systems operated, on any digital or analog media, and rely on them except in the case of manifest error.
ARTICLE 10: INDIVISIBILITY
The fact that any provision of the Contract is or becomes illegal or unenforceable shall in no way affect the validity or enforceability of the remaining provisions of the Contract.
ARTICLE 11: SETTLEMENT OF DISPUTES
The conclusion, interpretation and validity of this Agreement shall be governed by French law, regardless of the User's country of origin or the country from which the User accesses Le Lab de l'Endo and notwithstanding principles of conflict of laws.
In the event of a dispute concerning the validity, performance or interpretation of this Contract being brought before the civil courts, it will be submitted to the exclusive jurisdiction of the French courts, to which jurisdiction is expressly granted, even in the event of summary proceedings or multiple defendants.
The User is hereby informed that he/she may in any event have recourse to conventional mediation or any other alternative dispute resolution method (conciliation, for example) in the event of a dispute.
ARTICLE 12: DURATION OF THE GENERAL CONDITIONS OF USE
These general terms and conditions of use are concluded for an indefinite period, and the User is bound by them from the moment he begins to use the Services.
The Publisher reserves the right to modify this document at any time and without prior notice. Users will be informed each time the document is updated.
